Cornerstone of the United States: Freedom of Expression

 Introduction

Prior to the Declaration of Independence and Revolutionary War, the founding fathers were restricted in their actions and beliefs by the British Empire which they were subjects to. This is why the cornerstone of the United States Constitution is the first amendment which provides the freedom of speech, freedom of press, freedom to petition, freedom to assemble, freedom to practice religion, and freedom to not practice a religion. The freedom of speech aspect has been a contested topic throughout the country's short history as there has been debate over how far the first amendment protects freedom of speech and whether some topics and ideas should be censored. This has led scholars to come up with specific values of freedom of speech/expression which argue why the protection of the freedom of expression is so important for the success and peace of a country.

Venting is a Good Thing

One of the eight values that stuck out to me was suggested by Benedict Spinoza when he explained that allowing people to "vent" their frustrations is beneficial as it prevents violence. This is a plausible concept because if you look back at the history of the United States, there are examples of where allowing peaceful venting changed policies while restrictions caused conflicts. Look at the Civil Rights Movement, they peacefully used their right to freedom of speech/expression to initiate change in a nonviolent manner which successfully initiated change. Conversely, if you look at the abolition movement you see a lack of allowing people to vent their frustrations about the mistreatment of minorities and one of the results was the Civil War which was a horrible and bloody conflict that could have been avoided. It could have been avoided by allowing the minorities to have their voices heard and taken them seriously to initiate changes. Ultimately, thankfully changes were made, but allowing people to vent their frustrations actually alleviates conflict and promotes a healthy discourse. Recently, this venting has been done with protests to improve race relations and these protests have powered change and supported reforms.

It's Not Mob Rule!

Another important value to remember comes from Steve Shiffrin when he outlines his argument that it is not a mob rule of the majority and that as a part of a minority you have the right to express your beliefs and it is even your duty to do so. This is important because some people argue for censorship of certain people or unpopular beliefs. This can come from both sides of the political spectrum, different age groups, different sexes, etc. and this has led to the foundation of "cancel culture". An example of this contested cancel culture issue is currently going on back in my home state of Virginia where a group of students who are in the minority with their views are allegedly being silenced. Granted in many cases of these cancel culture incidents, there can be a valid argument that what they say or do is "bad", but their views need to be heard to help keep the majority and government accountable. Also, this freedom of expression helps people to make fully knowledgeable decisions which benefits the individual and the society as a whole.

A Path Toward Modernization

Jack Balkin explained in his value of the freedom of expression that free speech enables more innovation and creativity in a society. He said that it also makes a society more energized to fulfill their potential. This is true, innovation and new ideas comes from the free exchange of information. You can take a look at the United States as a perfect example because the U.S. has been ahead of many other countries over the last two and half centuries in modernization and productivity. This is especially evident in economical ways as the U.S. has been way ahead, but also in social terms. While it has taken a little longer, many minorities have been given equal status thanks to the freedom of expression and support of allies and now the United States is one of the most diverse and welcoming countries.

Conclusion

The United States is called the "land of the free" and this is because of the protections the citizens have from each other and from the government infringing upon their lives.  These protections stem from the first amendment where the freedom of expression for its citizens was officially established. The freedom of expression is very a important protection that makes the United States such a desirable place to live which is why you see the constant influx of people wanting to become U.S. citizens and to live a prosperous life provided by these principles.

The Highest Court in the Land

The Supreme Court of the United States has a unique and critical function in the successful running of the nation. When watching this video about the Supreme Court, I learned that the court reviews appeals from cases from lower courts where a law might be unconstitutional or when due process may have not been abided by properly. In addition, I learned that they sift through thousands of cases every year while only taking up about 100 every year. The longest part of the process is sometimes actually just writing their opinions because there has to be some sense of cooperation between the justices and then many of the results are released at the end of the term in June.

The most important point about the Supreme Court is that they have a specific process and mindset for deciding cases. We hear in the media today that the justices always align with their political beliefs in their decisions, and the beliefs usually align with the administration that nominated them. While there may some truth to these sentiments as their way of looking at things usually aligns with their political beliefs, it is not fully true. In truth, justices must interpret the case based only on strictly what the Constitution says, not what they believe to be necessarily morally "right". Also, the Supreme Court is possibly the most powerful of the three branches because of "judicial review" which allows to strike down or overturn anything from the other two branches as unconstitutional.

The fact that the court takes up so few cases in comparison to the number of appeals is surprising. Also, the justices said they took up around 100 cases every year, this number sounds actually pretty high to me as I am not familiar with many of their regular decisions that are not landmark decisions. Another surprising fact is that the Supreme Court was not always morally sound as sometimes they made horrible moral decisions such as Plessy v. Ferguson and others

The video showed me that the Supreme Court is not as political as people make it out to be. There is a reason and a rationale to all of their actions and decisions. Also, I used to think that the Supreme Court was very secretive about many of its actions, but in reality the way they do things and make decisions is not secretive and well known: interpret each case following the Constitution.

The Best Places to Get Your News

 To Begin

There are many options for staying up to date with the news. News sources usually cater towards a specific age, gender, political belief, etc. in order to have a solid base and consistent viewership. Growing up, I had parents and family members who were set in conservative political beliefs and that has influenced me and my decisions on where to read my news. While their beliefs have rubbed off on me, I do believe in finding out the real truth so I use a variety of news sources.

FOX NEWS

As I mentioned above, I grew up in a conservative household so we watched a lot of FOX News and that has trickled down to my tastes in where I get my news. FOX News is great for continual news coverage as it is constantly on air 24/7 to provide any news or updates. On the other hand, FOX News typically only reports news in a way that aligns with their right wing point of view as it is its demographic that continues to watch and support the network.

CNN

CNN or Cable News Network is similar in style to FOX News as it is on 24/7 365 days a year and can easily report and update the most recent news. CNN differs from FOX News as it takes a more liberal approach to reporting the news as that is its supporting demographic. I like to pay attention to CNN as it offers a different story than FOX News, and I can then compare stories from them both and find the truth that is somewhere in the middle. CNN is also one of my go-to's as it is one of longest running cable news network, so it has built up a reputation of effectively reporting news.

ESPN

ESPN or Entertainment and Sports Programming Network reports on the latest sports news. I typically keep up with ESPN because I am an avid sports fan. ESPN is in my opinion the most in depth and up to date when it comes to the analyzation sports. Also, ESPN contains the best database for finding out all of your sports needs as they report on almost all relevant sports, even some international sports. In addition, ESPN+, which is an add on to ESPN further improves my sports news needs with more articles and analysis while also providing documentaries.

WDBJ7

WDBJ7 is my favorite local, hometown news television station in Roanoke, Virginia that is in association with CBS. On WDBJ7 I can easily find some of the biggest international and national stories that are also found on FOX News and CNN. But the main purpose of using WDBJ7 is to learn about my state and local news as they have a large presence in the area and can easily report all of the needed local relevant information. Also, the local news tends to provide more positive local news which can put me in a better mood. In addition to regular news, you can easily find out the local collegiate and high school sports updates and local weather updates.

BBC

The BBC or British Broadcasting Corporation is based in the United Kingdom which can be effective for reading the news. The BBC is normally my go to for international news because in my experience U.S. news organizations focus more on internal news and information, while the BBC seems to have a more worldly approach. Also, the BBC provides an outsider's look into U.S. politics, policy issues, and news which can help me to see through the internal bias in the prominent U.S. news organizations. Lastly, the BBC helps give me insight into another country's (the United Kingdom's) news and issues.
